1. Acceptance of Terms

By accessing or using the Offroad Racing Classifieds website ("offroadracing.com.au", "the Platform", "we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use the Platform.

2. Platform Role & Use

The Platform operates solely as an online classifieds service that connects buyers and sellers of off-road racing vehicles, parts, accessories, and related items. We are not a dealer, broker, auctioneer, or party to any transaction. We do not buy, sell, lease, offer, negotiate, or complete transactions for any vehicles, parts, or items. The Platform merely provides a venue for users to advertise and discover listings.

You may use the Platform to browse listings, submit classified advertisements, and contact sellers. Any transaction that results from a listing on the Platform is conducted entirely between the buyer and seller, at their own risk.

You agree not to use the Platform for any unlawful purpose, to post misleading or fraudulent listings, or to interfere with the operation of the Platform.

3. Listing Submissions

All listing submissions are subject to review and approval by our team. We reserve the absolute and sole right to approve, reject, edit, or remove any listing at any time, for any reason or no reason, without prior notice or explanation. This includes but is not limited to listings that are inaccurate, misleading, duplicated, inappropriate, or otherwise in breach of these terms.

The decision to publish or remove a listing rests entirely with the Platform. No listing is guaranteed to be published or to remain on the site for any period of time. We are under no obligation to provide reasons for the removal or rejection of any listing.

You are solely responsible for the accuracy of the information you provide in your listing, including the description, price, condition, and specifications of any items advertised.

4. Image Rights & Content Licence

By uploading images or other content to the Platform, you represent and warrant that:

• You are the owner of the images or have obtained all necessary rights, permissions, and licences to use and submit them.
• The images do not infringe the copyright, trademark, privacy, or any other rights of any third party.
• You have obtained consent from any identifiable persons appearing in the images.

By submitting content to the Platform, you grant Offroad Racing Classifieds (offroadracing.com.au) a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your submitted images, text, and data for any purpose, including but not limited to:

• Displaying listings on the Platform and any affiliated websites or applications.
• Promotional and marketing materials, including social media, newsletters, and advertising.
• Editorial content, articles, and publications related to off-road racing.
• Use on any platform associated with offroadracing.com.au, including social media accounts, news publications, and partner websites.
• Sublicensing to third parties, including media outlets, publications, and other platforms not directly operated by offroadracing.com.au.
• Analytics, research, and platform improvement purposes.

This licence survives the removal or expiration of your listing. We may use your submitted content in any way we reasonably require, without restriction to platforms owned or operated by us.

5. Copyright & Takedown Requests

If you believe that your images, content, or copyrighted material have been uploaded to the Platform without your permission, please contact us immediately at info@offroadracing.com.au so we can investigate and take appropriate action.

You can also report a listing directly using the "Report" button on the listing page. When submitting a takedown request, please include:

• A description of the copyrighted work or material you believe has been infringed.
• The URL or location of the listing on our Platform.
• Your contact information (name and email address).
• A statement that you are the rights holder or are authorised to act on their behalf.

We will review all takedown requests promptly and may remove or disable access to the material in question at our sole discretion. Repeat infringers may be permanently barred from using the Platform.

6. No Warranty & Disclaimer

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any listing or content on the Platform.

We do not inspect, verify, endorse, or guarantee any vehicles, parts, or items listed on the Platform. We have no control over and accept no responsibility for the quality, safety, legality, or accuracy of any listing, the ability of sellers to sell items, or the ability of buyers to pay for items. All transactions are conducted directly between buyers and sellers at their own risk, and we are not a party to any transaction.

You should independently verify all information before entering into any transaction, including but not limited to the condition, specifications, registration status, compliance, and legal ownership of any item. We strongly recommend inspecting items in person and obtaining independent mechanical or professional inspections where appropriate.

We do not provide advice, opinions, or recommendations regarding any item listed on the Platform. Any information displayed on the Platform is provided by users and has not been independently verified by us.

7. Limitation of Liability

To the maximum extent permitted by law, Offroad Racing Classifieds and its operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to:

• Your use of the Platform or inability to use the Platform.
• Any transaction, agreement, or dispute between users of the Platform.
• Any content, listing, or information posted by users on the Platform.
• Any loss, injury, claim, or damage resulting from the purchase, sale, or use of any item listed on the Platform.
• Any unauthorised access to or alteration of your data or transmissions.

Our role is limited to providing the Platform as a venue for classified advertisements. We accept no liability for the conduct of any user, whether online or offline.

8. Privacy

Contact information provided during listing submission (name, email, phone number) will be used to manage your listing and facilitate enquiries from potential buyers. Your email address is never publicly displayed — buyer enquiries are forwarded to you via our server-side contact system. Your phone number may be revealed to buyers who request it through the Platform.

Your use of the Platform is also governed by our Privacy Policy, which forms part of these terms.

9. Indemnification

You agree to indemnify and hold harmless Offroad Racing Classifieds, its operators, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or relating to your use of the Platform, your listing content, or any breach of these terms.

10. Modifications to Terms

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the Platform following any changes constitutes acceptance of the revised terms.

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Australia.
